HOTEL COLLECTION OFFICIAL CONTEST RULES


1. CONTEST RULES


1.1. Sponsor. The contest ("Contest") is sponsored by Hotel Collection LLC ("Sponsor"), located at 38 NW 24th Street, Miami, Florida 33127.


1.2. Entry Period. The Contest entry period begins at 12:00 AM EST on February 1, 2024, and ends at 11:59 PM EST on March 31, 2024 ("Entry Period").


1.3. Eligibility. The Contest is open only to individuals who are legal residents of the State of Florida and are at least eighteen (18) years of age. Employees, officers, directors, members, managers, agents, and representatives of Sponsor and its parent companies, subsidiaries, affiliates, advertising and promotion agencies (collectively, "Contest Entities")and members of their immediate family (spouse, parents, children, siblings, and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, are not eligible.


1.4. How to Enter. To enter the Contest, an eligible individual ("Entrant")must create and submit via form a video that meets the submission requirements detailed in Section 1.6 below ("Submission") during the Entry Period. Entrants are to additionally upload their video submission to their official social media profile and tag @Hotelcollection and hashtag #underthesheets. Entrants must also follow Hotel Collection’s official Instagram and TikTok profiles. All required information must be provided to enter and to be eligible to win.


1.5. Entry Requirements. Each Submission:
(a) Must be in a format acceptable to Sponsor;
(b) Must be between 20-30 seconds in length;
(c) Must be Entrant's own original work;
(d) Must not infringe third-party rights; and
(e) Must not contain profane, offensive, or other inappropriate content, as determined by Sponsor in its sole discretion;(f) Must not contain any profound language or nudity.


1.6. Judging Criteria. The campaign’s central theme will revolve around the connection between the sensory satisfaction of their feet and the overall feeling of their well-being. All eligible Submissions will be judged based on creativity.


1.7. Winner Selection and Notification. On or about April 15, 2024, one (1) potential winner will be selected by a panel of qualified judges from among all eligible Submissions received during the Entry Period based on the judging criteria. The potential winner will be notified by phone, email, and/or mail.


1.8. Prize. One (1) Grand Prize will be awarded consisting of a cash payment of $5,000. The Prize is non-transferable no substitution by the winner is allowed. Sponsor reserves the right to substitute the prize for one of equal or greater value. The winner is responsible for all federal, state, and local taxes associated with acceptance and use of the prize.


1.9. General Rules. By entering, Entrants agree to abide by these Official Rules and all Sponsor decisions regarding the Contest, which are final.


2. INTELLECTUAL PROPERTY, PUBLICITY, PRIVACY


2.1. Each Entrant retains ownership of the copyright and other intellectual property rights in their Contest entry. By submitting an entry, the Entrant grants the Sponsor a perpetual, worldwide, royalty-free license to use, reproduce, modify, publish, display, distribute, and promote the entry for any purpose.


2.2.Entrant agrees not to submit any entry that infringes upon any third party's intellectual property rights or that constitutes copyright or trademark infringement. Entrant is solely responsible for ensuring their entry does not infringe on the intellectual property rights of any third party. Sponsor shall have the right to disqualify any entry on notice of any intellectual property infringement or allegations thereof.


2.3. By participating in the Contest, each Entrant grants Sponsor the perpetual right to use his/her name, likeness, biographical details, entry content, and other personal characteristics for promotional purposes in any media withoutcompensation or permission, except where prohibited by law.


2.4. Sponsor's privacy policy located at [URL] is incorporated into these Official Rules. By participating in the contest, each Entrant acknowledges and agrees to the collection, use, and disclosure of their personal information by the Sponsor in accordance with such privacy policy.


3. RELEASE; LIMITATION OF LIABILITY. IN NO EVENT WILL THE SPONSOR, AND/OR PROMOTER’SPARENT, SUBSIDIARY, LICENSEES, EMPLOYEES, AGENTS, OFFICERS, DIRECTORS, ASSIGNS, AFFILIATES, OR RELATED COMPANIES (COLLECTIVELY WITH SPONSOR, THE“SPONSOR PARTIES”), BE RESPONSIBLE OR LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTAL, OR PUNITIVE DAMAGES (INCLUDING WITHOUT LIMITATION LOSTPROFITS) ARISING OUT OF ANY ENTRANT’S PARTICIPATION IN THE SWEEPSTAKES, THESEOFFICIAL RULES, AND/OR ANY ENTRANT’S RECEIPT, USE, OR MISUSE OF A PRIZE, NOMATTER UNDER WHAT THEORY ARISING, EVEN IF ANY SPONSOR PARTY HAS BEENADVISED OF THE POSSIBLY OF SUCH DAMAGES. PROMOTER PARTIES’ ENTIRE LIABILITY WITH RESPECT TO: ANY ENTRANT’S PARTICIPATION IN THE SWEEPSTAKES, THESE OFFICIAL RULES, AND/OR ANY ENTRANT’S RECEIPT OF A PRIZESHALL BE LIMITED TO $500. SOME JURISDICTIONS MAY NOT ALLOW THE AFOREMENTIONED LIMITATIONS OR EXCLUSIONS OF LIABILITY AND AS SUCH, THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.


4. GOVERNING LAW; DISPUTES


4.1. These Official Contest Rules shall be governed by the laws of the State of Florida without regard to its conflict law provisions. Entrants agree that any and all disputes arising out of or relating to the Contest shall be resolved solely through binding arbitration under the Rules of the American Arbitration Association, to be held in Miami-Dade County, Florida. The decision of the arbitrator shall be final and binding on the parties and may be entered in any court of competent jurisdiction.
